Defamation Explained
January 10, 2020

What is Defamation, Libel, Slander

* When you use any social media platform, in this case, Facebook, you agree to their Terms of Service, which includes agreeing not to defame others by making untrue statements about another person or organization, which harms their reputation.

Generally, defamation is a false and unprivileged statement of fact that is harmful to someone's reputation and published "with fault," meaning as a result of negligence or malice.

* Whenever you are the victim of internet defamation or being wrongfully accused of online comments (defamation).

* Defamation is a statement that injures a third party's reputation. The tort of defamation includes both libel (written statements) and slander (spoken comments).

"A" -

* First, you must prove that the statement is a false statement of fact. A fact is different than an opinion. A fact statement may turn out to be true or false. Opinions generally cannot be prosecuted as defamation.

"B"

* The false statement of fact must damage your reputation. To constitute libel, the written article must not only be incorrect but also harm you or your company's reputation and cause harm.

"C"

* The false statement of fact causing harm must be made without adequate due diligence or research into the truthfulness of the statement. Alternatively, plaintiffs often attempt to prove that the false statement of fact was made with full knowledge of its falsity.

"D"

* If the originator of the false statement of fact is a celebrity or public official, the plaintiff must also prove "maliciousness" Malicious behavior occurs when the person posting the information on the Internet intends to cause harm or recklessly disregards the truth when speaking.

Conclusion

* Conclusion: if you did your homework and got a positive result, you don't need "LEGIT CHECK" on the Internet. If the answer is negative, follow your instincts and don't go ahead with the offered deal.

The Advise of the Old Wise Man:

In my blog, I always describe the pros and cons. I will never decide unilaterally.
I intend to advise you on this subject and encourage you to do your homework before posting stories on the internet. In addition, I gave you an exercise - An example of how to spot scammers in transient business.

Complete privacy exists only in the desert of this world, and anyone who is not a hermit must anticipate and endure the ordinary events of the community life of which he is a part. He must therefore expect his neighbors to be more or less casually observing what he is doing and his comings and goings and ordinary daily activities as described in the press as a matter of casual interest to others.

The common sense person does not take offense to a report in a newspaper that he has returned from a visit, gone camping in the woods, or thrown a party at his house for his friends. Even minor and moderate nuisance, such as publicly disclosing facts that the plaintiff fell awkwardly down the stairs and broke his ankle, is not sufficient to give him cause of action under the rule outlined in this section. Only if the publicity it has received is such that a reasonable person would feel justified in feeling seriously disadvantaged by it will there be a cause of action.
